We facilitate connections between users and independent recyclers for the pickup and purchase of vehicles, scrap cars, and scrap materials through quote request forms. When you submit a form, our team or one of our independent recycling partners will handle your request.
smashscrap.ca Ltd acts solely as a facilitator connecting you with independent recyclers. SMASH is not a party to any transaction between you and a recycling partner. No recycling partner is an agent, employee, or representative of SMASH, and SMASH does not act as agent for any user or partner. SMASH does not buy, sell, tow, take title to, take possession of, or take custody of any vehicle, scrap metal, or materials at any time. All pricing, inspection, pickup, payment, title transfer, and compliance obligations are solely between you and the recycling partner.

The sale, transfer, or disposal of vehicles and scrap materials may be subject to provincial, state, and federal laws, including requirements for title transfer documentation, valid government-issued identification, and bill of sale. You agree to provide all documentation reasonably required by our recycling partners to complete a transaction lawfully. SMASH and its recycling partners reserve the right to refuse service if required documentation is not provided or if ownership cannot be verified.

You acknowledge and agree that SMASH acts solely as a facilitator connecting you with recycling partners, and that SMASH does not take possession, ownership, or custody of any vehicle, scrap metal, or materials at any time.
YOU AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS SMASH AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND AFFILIATES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE LEGAL FEES) ARISING FROM OR RELATED TO: (A) ANY MISREPRESENTATION REGARDING YOUR OWNERSHIP OR AUTHORITY TO SELL THE MATERIALS; (B) ANY CLAIM OF THEFT, STOLEN PROPERTY, FRAUD, OR MONEY LAUNDERING RELATED TO MATERIALS YOU SUBMITTED THROUGH THE WEBSITE; (C) ANY DISPUTE BETWEEN YOU AND A THIRD PARTY REGARDING OWNERSHIP OF THE MATERIALS; OR (D) ANY VIOLATION OF APPLICABLE LAWS RELATED TO THE SALE, TRANSFER, OR DISPOSAL OF THE MATERIALS.
SMASH reserves the right to report suspicious activity to law enforcement authorities and to cooperate fully with any investigation related to stolen property, fraud, or money laundering.
Submitting a form does not guarantee a specific offer amount. Quotes provided by our team or partner recyclers are based on the information you provide and current market conditions. Final pricing may be adjusted upon inspection of the vehicle or materials. SMASH does not set, control, or guarantee any pricing offered by recycling partners. Any transaction is entered into directly between you and the recycling partner.

smashscrap.ca Ltd is not responsible or liable for any property damage, including but not limited to damage to driveways, landscaping, fencing, or structures, caused by third-party recycling partners or towing services during the inspection, removal, or transportation of vehicles or materials. Any claims for property damage must be directed to the recycling partner responsible.
TO THE FULLEST EXTENT PERMITTED BY LAW, SMASH AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR REPUTATION, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE OR THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF SMASH FOR ALL CLAIMS RELATED TO THE WEBSITE OR THE SERVICES EXCEED FIVE HUNDRED CANADIAN DOLLARS (CAD $500).

Amendments will take effect thirty (30) days after the amended version is posted. If you continue to use the website or Services after the 30-day period, you agree to the amended Terms. If you disagree with any amendments, your sole remedy is to cease using the website and Services within the 30-day notice period.

Notwithstanding the foregoing, smashscrap.ca Ltd shall be entitled to seek injunctive or other equitable relief from any court of competent jurisdiction.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and smashscrap.ca Ltd with respect to use of the website and Services, and supersede all prior or contemporaneous agreements, communications, and proposals.
